Tenants' regulations

I. Preliminary Clauses

A Tenant who takes advantage of this Service is taken to have accepted, and declared that they have understood the Use of Internet Service Regulations.
A Tenant is anyone who registers with the Service as a Tenant i.e. a person who intends to take advantage of the property booking agency service.
A Landlord is anyone who registers with the Service as a Landlord i.e. a person who intends to take advantage of the property rental agency service.
These clauses specify the terms and conditions binding to any Tenant who wishes to book Property and sign a property rental agreement with Landlord.
The Administrator is not a party to any property rental agreement but provides agency services, leading to the signing of property rental agreements. Property rental agreements are always concluded between Landlord and Tenant.
II. Registration with the Service

Registration with the Service is conditional on:
filling in a form with personal details and e-mail address
getting acquainted with the Use of Internet Page Regulations, Tenant's Regulations and Dotpay Payment Regulations
accepting all of the regulations specified above in section 1b.
Registration with the Service is an automatic confirmation of the personal data provided by Client to be correct and true.
III. Booking, payment

Once the registration with the Service is completed, the Tenant can take advantage of:
a. instant booking confirmation
b. 24 hours booking confirmation
c. 24 hours confirmation with 5 minute enhancement (confirmation by telephone call or text message)
In any case, the availability of the types of booking specified above depends on whether Landlord makes it available for a given Property.
Instant booking confirmation involves:
getting registered with the Service, according to the general provisions of the service regulations.
choosing the required search parameters, including arrival/departure dates, number of adults, children, tenants' sex, choice of city;
payment of the booking fee, depending on the form of payment selected i.e. credit card or money transfer.
receiving a confirmation from the Administrator about the booking made, together with a link to the client panel, where an electronic voucher with the information necessary to realize the booking is generated, based on the data provided by Landlord. The voucher includes data of the person in charge of the Property, and details of the person who collects the remaining rental fee.
in case of booking cancellation the booking fee is non-refundable. Any other costs relating to the cancellation, specific to the Property and specified in the Property description, will be charged to the Tenant's credit card.
24 hours confirmation booking involves:
registration with the Service according to the general provisions of the service regulations.
making a choice from the required search parameters, including arrival/departure dates, number of adults, children, tenants' sex, choice of city;
filling in and sending a booking form through the Service
receiving an acceptance from the Landlord, based on the terms and conditions specified in the booking form.
payment of a booking fee, no later that 24 hours calculated from the time of receiving an acceptance of the booking from Landlord, dependent on a selected form of payment i.e. credit card or money transfer.
receiving a confirmation from the Administrator about the booking made, together with a link to the client panel, where an electronic voucher with information necessary to carry out the booking is generated, based on the data provided by Landlord. The voucher includes data of the person in charge of the Property and details of the person who collects the remaining rental fee.
in case of booking cancellation the booking fee is non-refundable. Any other costs relating to the cancellation, specific to the given Property and specified in the Property description will be charged to the Tenant's credit card.
24 hours booking with 5 minute enhancement (confirmation via telephone call or text message) is equivalent to the booking discussed in section III.4, with additional confirmation to the Tenant, within 5 minutes of booking submission, by telephone call or text message
Failure to pay the booking fee results in cancellation of the booking.
The booking fee and the remaining money paid for the property rental are non-refundable.
The Tenant can pay the remaining money for the property rental via the Service, if such an option is available or, personally, in cash to the person in charge of the Property, at the time of handing over the key to the Property, and in a form specified for the booked Property.
The Administrator shall bear no responsibility for any individual arrangements that Landlord and Tenant have made with regards to the rental price, and any misunderstandings that might arise in the process.
The rental price includes gas, electricity, water and cleaning-upon-leaving charges
Transport to the property, price of meals or any other arrangements with regards to the Tenant's stay in the Property are not included in the rental price.
Any changes to the terms of rental in relation to the terms and conditions provided in the voucher shall be agreed between Landlord and Tenant without any mediation or additional agency service provided by the Service.
The Administrator shall bear no responsibility for the effects of any mistaken or wrong information or data included in the voucher, or failure by the Landlord to hand over the key to the Property at the agreed time and place, or failure to make the Property available to the Tenant for the period of confirmed booking.
The Administrator shall not be responsible for the quality of additional services offered by Landlord in the Property Regulations.
IV. Arrival, handing over of the key, departure

The arrival should take place at the time recorded by the Tenant in the client panel and generated in the electronic voucher. Any changes to the time and other details of arrival shall be made in the client panel.
On the arrival date, the Client shall inform the person in charge of the Property of any delays with regards to the arrival time and any arrangement made for handing over the key
Hotel nights begin at the time indicated in the Property Regulations, unless it has been agreed otherwise with Landlord.
The number of people who intend to stay in the Property is limited to the number quoted in the voucher. The person in charge of the Property may refuse to hand over the key if the number of people actually arriving exceeds the number quoted in the voucher.
Tenant shall take care of the principles of good neighbourly conduct and keep the Property in the condition in which they found it.
The Tenant shall immediately notify the Landlord of any defects or damage found at the Property, and of any items requiring repair at the time of booking. The cost of any damage and repair that occur at the time of booking shall be paid for by the Tenant directly to the Landlord. The Service bears no responsibility for any related disputes.

V. Booking alterations

The booking fee is non-refundable. Booking dates can be changed, conditional on agreeing the change with the Landlord (especially with regards to the availability of the Property on the newly requested dates). Such modifications can be made only within the same Property.
The Landlord can impose additional charges for the alteration of the booking dates.
When booking dates are altered, the original booking shall be annulled by clicking on the appropriate link sent by the Administrator via email in which the booking was first confirmed, and only then a new booking with new dates should be made quoting the original booking number in the 'comments' box. When a new booking is made in the more expensive season, the difference in price shall be paid to the person in charge of the Property on the arrival date.
The Tenant's stay in the Property can be extended through the client panel, using the type of booking specified by the Landlord, and only if the Property is available.
The number of people staying in the Property quoted in the voucher can be changed in the client panel, in the booking details. The price increases with the increased number of people staying in the Property. The change of booking is finalized when the Landlord accepts the modifications requested by the Tenant.
VI. Transferring the client's rights and duties onto a third party.

The Client can transfer all his rights and duties to a third party, if the third party agrees to take over all the terms and conditions of the booking. In such a situation, the Administrator shall be immediately informed of the modification, and the personal details of the person who shall take over all of the rights and duties specified in the contract agreement should be given without delay.

VII. Other pricing arrangements

Details of payment for children or animals (if animals are allowed to stay) are specific to each Property, as specified in the Property Regulations published with the Service.

VIII. Force Majeure

In case of unforeseeable circumstances the Landlord reserves the right to offer a replacement Property to the Tenant, which should be of a similar standard to the one originally booked. The Tenant has the right to terminate the rental contract in case of the occurrence of such unforeseeable circumstances. This also applies to the instances where Tenants' personal safety or the safety of their possessions can not be guaranteed due to the circumstances outside of the Landlord's control. In such a situation all money already paid by the Tenant is immediately returned, with the exception of the deductions for the services already rendered.
